Muse Copyright & Intellectual Property Policy

1. Introduction

Muse ("the App", "we", "us", or "our") is an independent fragrance discovery, editorial, and creative platform owned and operated by WABLOO PARTNERS SRL, a company incorporated and existing under the laws of Romania.

Muse enables users to discover perfumes and create, generate, upload, share, and explore community-created visual interpretations inspired by fragrances and their olfactory profiles.

Muse is not affiliated with, endorsed by, sponsored by, authorized by, or officially associated with any perfume manufacturer, fragrance house, trademark owner, or brand unless explicitly stated.

All intellectual property rights relating to the Muse platform, including its software, databases, editorial content, recommendation systems, AI generation systems, community curation features, and related services, are owned by WABLOO PARTNERS SRL or its licensors.

2. Nature of Content on Muse

Content available on Muse may include:

  • Factual perfume information and metadata;

  • Original editorial descriptions and summaries created by Muse;

  • Community-created content;

  • User-uploaded photographs and media;

  • AI-generated artistic interpretations and visual representations inspired by fragrances and their olfactory identities;

  • Community comments, reviews, ratings, tags, and collections.

Images displayed on Muse are community-generated or user-submitted materials intended for informational, artistic, educational, editorial, and entertainment purposes.

The appearance of any fragrance, product name, bottle shape, packaging, color palette, logo, trade dress, or other recognizable visual element within community-created content does not imply affiliation, sponsorship, authorization, approval, or endorsement by any fragrance brand.

Muse does not represent community-generated content as official brand materials.

3. Factual Perfume Information

Muse may display factual information relating to perfumes, including but not limited to:

  • Brand names;

  • Product names;

  • Release years;

  • Perfume notes and accords;

  • Perfumers;

  • Concentrations;

  • Product characteristics and classifications;

  • Community opinions and ratings.

Such information is presented solely for informational, editorial, educational, research, and community purposes.

Facts and opinions displayed on Muse are not intended to represent official statements of any fragrance house, manufacturer, or rights holder.

4. Trademarks and Brand Names

All trademarks, service marks, logos, product names, trade names, bottle designs, trade dress, and brand names appearing within Muse remain the property of their respective owners.

References to perfume names, brands, products, and associated visual characteristics are made solely for identification, editorial commentary, community discussion, review, informational, educational, artistic, and discovery purposes.

The presence of any brand, perfume, product name, trademark, logo, or recognizable product characteristic within Muse does not create any relationship, partnership, endorsement, sponsorship, approval, authorization, or affiliation between Muse and the applicable rights holder.

5. Community-Created Images and AI-Generated Content

Muse allows users to:

  • Generate AI-created visual interpretations inspired by fragrances;

  • Upload photographs and artistic creations;

  • Share and explore community-generated galleries;

  • Create collections and themed image sets;

  • Vote on and feature community-selected hero images.

Community-generated images displayed on Muse may depict fragrances, bottles, packaging, names, colors, shapes, and other recognizable characteristics associated with perfumes.

Such depictions constitute community-created artistic, editorial, illustrative, and expressive interpretations and are not represented as official product photography, official marketing materials, brand-approved assets, or statements by any fragrance brand.

Featured images and community-selected hero images are chosen solely for artistic, editorial, and community engagement purposes and do not imply endorsement, sponsorship, authorization, partnership, or approval by any rights holder.

The creator's username, attribution, tags, prompts, and related metadata may be displayed alongside the content.

6. User Responsibilities

By uploading, generating, publishing, or otherwise submitting content through Muse, you represent and warrant that:

  • You own the content or possess all necessary rights and permissions to submit it;

  • Your content does not violate applicable law;

  • Your content does not intentionally infringe the intellectual property rights of others;

  • You have the right to grant Muse the licenses necessary to display and operate the service;

  • The information you provide is accurate to the best of your knowledge.

Users remain solely responsible for the content they submit.

Muse does not pre-screen all community content and cannot guarantee that all user-submitted materials are free from intellectual property claims.

Muse reserves the right, in its sole discretion, to remove, disable, replace, restrict, or otherwise limit access to any content, whether or not an infringement claim has been proven, if Muse reasonably believes that such action is necessary to:

  • Protect intellectual property rights;

  • Comply with applicable law;

  • Reduce legal risk;

  • Preserve the integrity and operation of the platform;

  • Protect users, rights holders, or Muse.

7. License Granted to Muse

By submitting, uploading, generating, publishing, or otherwise making content available through Muse, you grant WABLOO PARTNERS SRL a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to:

  • Host;

  • Store;

  • Reproduce;

  • Display;

  • Publish;

  • Distribute;

  • Modify solely for formatting and technical purposes;

  • Create thumbnails, previews, and promotional excerpts;

  • Feature and promote content within the App and related services.

This license exists solely for the operation, promotion, improvement, and provision of Muse and its services.

You retain ownership of your original content.

8. Copyright and Intellectual Property Complaints

Muse respects intellectual property rights and expects its users to do the same.

If you believe that content available through Muse infringes your copyright, trademark, design rights, trade dress rights, publicity rights, or other intellectual property rights, please provide:

  1. Identification of the protected work or rights allegedly infringed;

  2. Identification of the content to be removed, including sufficient information to locate it;

  3. Your full name and contact information;

  4. Company information, if applicable;

  5. A statement that you have a good-faith belief that the use is unauthorized;

  6. A statement that the information provided is accurate and that you are authorized to act on behalf of the rights holder.

9. Notice-and-Takedown Procedure

Upon receiving a valid complaint, Muse may:

  • Investigate the reported content;

  • Request additional information;

  • Temporarily disable access to the content;

  • Remove or replace the content;

  • Restrict or suspend repeat infringers;

  • Take any other action reasonably necessary to protect intellectual property rights and comply with applicable law.

Muse will make reasonable efforts to respond promptly to legitimate requests.

The decision to remove, restrict, replace, or retain content shall be made in Muse's reasonable discretion and in accordance with applicable law.

10. Repeat Infringer Policy

Muse may suspend or terminate accounts that repeatedly upload content alleged to infringe intellectual property rights.

Determinations regarding repeat infringement shall be made in Muse's reasonable discretion and may consider:

  • The number of complaints received;

  • The nature and credibility of complaints;

  • The user's history of compliance;

  • Any information provided by the user or rights holder.

Muse reserves the right to permanently restrict access to users who repeatedly violate intellectual property rights.

11. Counter-Notice Procedure

If your content has been removed and you believe the removal was incorrect, you may submit a counter-notice by contacting:

Your counter-notice should include:

  • Identification of the removed content;

  • Your contact information;

  • An explanation of why you believe the removal was incorrect;

  • A statement that the information provided is accurate.

Muse may, but is not obligated to, review and restore content following a counter-notice.

12. No Representation of Official Materials

Unless expressly stated otherwise:

  • Images on Muse are not official product photographs;

  • Images on Muse are not official marketing materials;

  • Images on Muse do not imply endorsement, sponsorship, or approval by fragrance brands;

  • Community galleries represent artistic, editorial, and user-generated interpretations inspired by fragrances.

The fact that community-created images may depict fragrances, bottles, packaging, names, colors, shapes, logos, or other recognizable characteristics does not imply that such materials are official representations of any product or brand.

13. Protection of Muse Content

Except for third-party trademarks and user-generated content owned by their creators, all rights in and to Muse, including but not limited to:

  • Software and source code;

  • Original editorial content;

  • Descriptions and summaries created by Muse;

  • Databases and compilations;

  • Metadata structures and taxonomies;

  • Rankings and recommendation systems;

  • User interface designs;

  • Algorithms and features;

  • Community organization and curation;

  • Hero image selections and gallery arrangements;

  • AI generation systems and prompts;

  • Prompt templates and workflows;

  • Search systems and recommendation methodologies;

  • Website content and related services;

are owned by WABLOO PARTNERS SRL or its licensors and are protected by applicable intellectual property laws.

No person may:

  • Systematically scrape Muse;

  • Copy substantial portions of the database;

  • Republish Muse content;

  • Create derivative databases;

  • Mirror the service;

  • Extract metadata, prompts, or taxonomies;

  • Use automated tools to collect content;

  • Train artificial intelligence, machine learning, search, recommendation, or generative systems using Muse data;

  • Create competing services using Muse content without prior written permission from WABLOO PARTNERS SRL.

Unauthorized use of Muse content may result in suspension, termination of access, and legal action.
